A release of earnest money addendum is a waiver attached to a purchase agreement that relays how an earnest money deposit made by the buyer will be distributed. The form instructs the agent holding the deposit to distribute the funds held in escrow.

The offer should include: Amount of earnest money you are willing to commit (generally 1%-3% of the purchase price) and who will hold the money during the escrow period. Earnest money serves as a good faith deposit and is usually applied at closing to your down payment and closing costs.

When the transaction is complete, the Earnest Money is credited toward the buyer's down payment. In most situations, if the seller terminates the transaction the Earnest Money is returned to the buyer. However, if it is the buyer who terminates the transaction, the Earnest Money is generally awarded to the seller.

Remember, the contract determines if and when earnest money is returned. Once the buyer or seller terminates the contract, the buyer will sign and submit a Release of Earnest Money form (TAR Form 1904) to the listing agent. This form is from the Texas Association of Realtors and not TREC.

A Contract termination and release of earnest money agreement serves to terminate an existing contractual relationship between a seller and a buyer, and provides for a release of any earnest money put up by the buyer. Upon full execution, both parties shall be released from any further obligations under the contract.

Release of Earnest Money The buyer, seller, and their agents must all sign the release before the title company will cut a check. Once the title company who is holding the earnest money has received the release, they can write a check available for pickup or mailing.

The standard form most agents use is the TAR Release of Money Texas form. This form must be signed by the seller and buyer and delivered to the title company. Once it is received, the earnest money will be released back to the buyer.

In most real estate markets, the average good faith deposit is between 1% and 3% of the property's purchase price. It can be as high as 10% for highly competitive homes with multiple interested buyers.
