EPA Regulations for Landlords Prior to renting or leasing a home, all Colorado-based landlords are legally obligated to report any and all known hazards on the property – including the presence of lead paint.

Under Title X, before ratifying any contract a landlord or seller must disclose any known lead-based paint or hazards on the property.

Lead-Based Paint: Banned Since 1978. Lead-based paint can be found found in older residential properties built before 1978. So if your property was built prior to 1978, the lead-based paint disclosure document will be important for you to understand.

There are two forms: Lead-Based Paint Disclosure (Sales) and Lead-Based Paint Disclosure (Rentals). Property owners must use these forms for all properties with building permits prior to January 1, 1978.

EPA Regulations for Landlords Prior to renting or leasing a home, all Colorado-based landlords are legally obligated to report any and all known hazards on the property – including the presence of lead paint.

In California, all homes built before 1978 are presumed to contain lead. (17 Cal. Code Regs., § 35043.)
