Enforcing a foreign court judgment usually requires assistance from a court, and sometimes law enforcement within the court's jurisdiction, to ensure compliance with the court's decision. Before a US court will enforce a judgment issued by a foreign court, the US court must first recognize the judgment.

Generally, U.S. judgments cannot be enforced in a foreign country without first being recognized by a court in that foreign country. The recognition and enforcement of U.S. judgments depend not only on the law of the foreign country, but also on the principles of comity, reciprocity, and res judicata.

A foreign judgment which is conclusive under Section 13 of the code may be enforced by instituting execution proceedings under Section 44-A in the case of 'reciprocating territories' (see question 1.2) or by instituting a civil suit on the judgment in the case of non-reciprocating territories.

A suit for the foreign judgement should be filed within 3 years from the date of the judgment. In case of a foreign judgement not being recognised as conclusive, an enforcement suit cannot be initiated.
