Some employers choose to offer severance pay to employees who are terminated, either involuntarily or voluntarily. The primary reasons for offering a severance package are to soften the blow of an involuntary termination and to avoid future lawsuits by having the employee sign a release in exchange for the severance.

Unless your employment contract, collective bargaining agreement, or company policy says otherwise, or your employer wrongfully terminated you for legally prohibited reasons, your employer owes you nothing when you resign.

Texas law prohibits individuals from qualifying for unemployment benefits while receiving certain types of severance pay. We make a decision on whether the severance pay affects the claimant's benefits. You must report any severance pay to TWC when you respond to the Notice of Application.

For example, a severance contract could include a severance pay term granting one week's pay for each year of service to the employer. Although not required, some employers may also offer other severance benefits, such as job counseling or payment of COBRA expenses, as part of an overall severance “package.”

Most employers include a severance pay in their packages. This is typically the employee's salary and is offered for a certain time period that the employer decides on. The typical severance pay employers offer is one to two weeks for every year the employee worked.

Entitlement to severance pay Every retrenched employee has a right to be paid severance pay by the employer if s/he has completed at least one year of continuous service with the employer prior to retrenchment.

Under the Texas Payday Law, severance pay is not owed unless it is promised in a written policy. Be sure to understand the difference: Most employers designate any post-employment wages paid to ex-employees as severance pay.

The severance pay offered is typically one to two weeks for every year worked, but it can be more. If the job loss will create an economic hardship, discuss this with your (former) employer. The general practice is to try to get four weeks of severance pay for each year worked.

For salaried employees: If your salary is $100,000 per year, that is $4,000 for two weeks (given the cap is 25 weeks). If you have been at the company for 10 years, your severance pay would be $40,000 ($4,000 X 10 years). Remember severance pay is not always given; it is dependent on the scenario with your employer.
