A Kentucky statutory power of attorney form provides a method by which a person can transfer their authority to conduct financial acts to another person. The person transferring the power is known as the “principal” while the person who is receiving the authority to act is called the “agent” or “attorney-in-fact”.

Requirements. To be eligible to sit for the KY Bar Exam, applicants must have a Juris Doctorate degree (JD) from a law school approved by the American Bar Association (ABA) and have been deemed to be of sound moral character and fit to practice law via The Character and Fitness Committee.

If you will be represented by a third party, whether in person or by correspondence, you must file a power of attorney specifically authorizing the individual to represent you or your organization. Kentucky Form 20A100 "Declaration of Representative" is used for this purpose.

Previously, Kentucky laws used to require that two disinterested witnesses sign the power of attorney as well. But since mid-2018, notarization has been sufficient. Still, if you anticipate conflict—such as family members protesting the validity of the POA—having your POA witnessed might help down the line.

The person making a power of attorney must be of sound mind and have the mental capacity to know what they are doing. It should be notarized. While Kentucky does not technically require you to get your POA notarized, notarization is very strongly recommended.
