Regulation 37 of MARPOL Annex I requires that oil tankers of 150 gross tonnage and above and all ships of 400 gross tonnage and above carry an approved Shipboard Oil Pollution Emergency Plan (SOPEP).
In addition, OPA 90 requires that these regulated facilities and vessels to submit these oil spill plans to various Federal agencies for approval. These emergency OPA 90 vessel response plans are required to contain detailed information as to how they will respond to small, medium, and worst-case spills.
The Ship Oil Pollution Emergency Plan (SOPEP) requires any ship with a gross tonnage of 400 tonnes or over, or any oil tanker with a gross tonnage of 150 tonnes or over to carry an oil prevention plan.
The purpose of the SOPEP is to provide guidance to the Master and officers on board the ship with respect to the steps to be taken when an oil pollution incident has occured or is likely to occur.
Thus, SOPEP covers the prevention of pollution arising from an oil pollution incident and SMPEP prevents or controls pollution by Noxious Liquid Substances or chemicals. When oil pills are on deck, it is not considered pollution. But when it spills on the water, it is officially called oil pollution.
(a) A vessel response plan must be reviewed annually by the owner or operator. (1) This review must occur within 1 month of the anniversary date of Coast Guard approval of the plan. (2) The owner or operator shall submit any plan amendments to the Coast Guard for information or approval.
SOPEP includes drawing of various fuel lines, along with other oil lines on board vessel with the positioning of vents, save all trays etc. The general arrangement of the ship is also listed in SOPEP, which includes the location of all the oil tanks with capacity, content etc.
The six-month period between the required resubmission date and the Plan's expiration date provides enough time to for the Coast Guard to review the Plan and the Owner/Operator enough time to respond to deficiencies, if any.
