What happens after someone files a complaint with the BC Human Rights Tribunal?

There are options available to the parties. They can agree to settle the complaint. The respondent can respond to the complaint and can apply to have the complaint dismissed. If the complaint is not resolved or dismissed, the Tribunal holds a hearing to decide if there was discrimination.

The BC Human Rights Tribunal (the tribunal) is responsible for dealing with human rights complaints made under the BC Human Rights Code. The tribunal is where you can make a complaint that someone has discriminated against you under the Code.

The Tribunal began the 2021/22 fiscal year with backlogs attributable to steadily growing case volumes which had increased to 2,656 in 2020/21 with the onset of the Covid-19 pandemic. The 2021/22 fiscal year set a new record with people filing 3,192 new cases with the Tribunal.

What You Need to Know. You should file a complaint within 12 months of the act or treatment that you are complaining about. The Commission does make exceptions. You can file a complaint on behalf of others as long as you have their consent.

Once we receive your completed Complaint Form, we will review it to ensure that it meets all the necessary criteria of a human rights complaint. We may contact you to get more information. After we have reviewed the complaint, we will decide whether it can be accepted. Not all complaints we receive are accepted.

It usually takes about one to two months for the Tribunal to decide if can deal with a complaint. If the parties agree to mediate, this usually takes about four months from the time the Tribunal notifies the respondent about the complaint.
