A witness may be qualified as an expert based on knowledge, skill, experience, training, or education. The standard is a minimal one. The witness need not be the best available expert or have extensive training. The expert's qualifications must be established on the record before the witness is asked to give opinions.

An expert may be appointed by a party or the tribunal and such appointment is governed by the law of the seat. Various national legislations[1] as well as the UNCITRAL Model Law[2] and institutionalised rules[3], give the tribunal the power to appoint an arbitrator unless agreed otherwise by the parties.

The role of the expert witness is to assist the court through the provision of an independent and unbiased opinion about matters coming within the expertise of the witness. This duty is paramount. It overrides the obligations of the witness to the party on whose behalf he or she is called to testify.

Under amended Rule 194, disclosures are due within 30 days after the first answer is filed. Further, a party cannot serve discovery until after the initial disclosures are due, unless otherwise agreed to by the parties or ordered by the court.

Rule 190 - Discovery Limitations 190.1 Discovery Control Plan Required. Every case must be governed by a discovery control plan as provided in this Rule. A plaintiff must allege in the first numbered paragraph of the original petition whether discovery is intended to be conducted under Level 1, 2, or 3 of this Rule.

The Court may receive expert evidence by various means: parties may engage their own individual experts to give evidence in Court. parties may agree to appoint a single expert who will give evidence in Court. the Court may appoint an expert to assist the Court in various ways, including by giving evidence in Court.

Unlike the federal rules, the Texas rules do not require a party to automatically produce an expert report upon disclosing a testifying expert. Nevertheless, upon request the other party is entitled to copies of reports prepared by or for the expert in anticipation of the expert's testimony.

An expert witness is a person with extensive experience or knowledge in a specific field or discipline beyond that expected from a layperson. The expert witness's duty is to apply their expertise to give a professional opinion to the tribunal or court on particular matters in dispute.

Under the Court Procedures Act 2004 (ACT) nor the Court Procedure Rules 2006 (ACT) there is no requirement that an expert report be served as an affidavit. b) Whether in the light of any such evidence, the expert witness wishes to modify any opinion given earlier.
