Texas law provides that every county in the state have a Small Claims Court as a forum for settling legal disputes involving cases for money damages up to $10,000. It costs approximately $85 to file a case.

A person who starts legal proceedings. This person then becomes “a party” to the proceedings. (In the context of divorce proceedings issued before 6 April 2022, the applicant is referred to as the petitioner.)

The petitioner is the party who presents a petition to the court. On appeal, the petitioner is usually the party who lost in the lower court. This can be either the plaintiff or defendant from the court below, as either of the parties can present the case to a higher court for further proceedings. See also respondent.

If the judge requests the defendant to pay, you will need to pay within 14 days. If you decide not to pay because you cannot afford the payment along with essential living costs, the claimants may first try to gather information about your personal finances. This will tell them if you can afford to pay or not.

Federal civil juries consist of six persons. plaintiff - The person who files the complaint in a civil lawsuit.

File Suit. To start your lawsuit, you'll prepare a form called a Petition. Give this form to the Clerk of the Court (filing). The person who files the Petition is called the Plaintiff. (See Texas Rules of Civil Procedure Rule 22.)

Applicant The individual, organisation or corporation who/which applies to the Court to start legal proceedings against another person or persons. Also known as 'plaintiff' in admiralty and corporations matters and in some other courts.

The respondent can be either the plaintiff or the defendant from the court below, as either party can appeal the decision thereby making themselves the petitioner and their adversary the respondent. Formerly, in the equity courts of common law, the defendant was always called the respondent. see also petitioner.

In most cases, counting from the day you were served, you have 20 days plus until the following Monday, at 10 a.m. to file your Answer. Count all the calendar days including weekends and holidays. However, in some kind of cases, the Answer deadline is shorter than 20 days.
