You can also visit the county Clerk's office to get a copy of the Declarations of Covenants Conditions and Restrictions for the neighborhood. Easiest way to find deed restrictions is pulling them up in the county records as they are public knowledge.

Most deed restrictions have an average life span of 25 to 30 years. Some are in effect “in perpetuity.” Many deed restrictions contain a provision for automatic renewal after the initial 25 to 30 year span, unless the owners take action to prevent renewal.

Deed restrictions are written agreements that restrict, or limit, the use or activities that may take place on property in a subdivision. These restrictions appear in the real property records of the county in which the property is located. They are private agreements and are binding upon every owner in a subdivision.

Chapter 211 allows the property owners to adopt a new method to amend their deed restrictions.

Look in the property deed and/or your seller's real estate disclosures to figure out if there are any subdivision covenants and restrictions. You can also visit the county Clerk's office to get a copy of the Declarations of Covenants Conditions and Restrictions for the neighborhood.

CAN DEED RESTRICTIONS BE WAIVED IN TEXAS? Under Texas law, restrictive covenants may be waived, and waiver is ordinarily a question of fact.

Notably, deed restrictions are not always legally enforceable in Texas. In order to be legally valid, a deed restriction must be reasonable, lawful, and consistent with public policy.

Deed restrictions may expire after a certain time period or need judicial proceedings in order to change. HOA rules, on the other hand, can be changed with a simple vote from the HOA board.

These restrictions appear in the real property records of the county in which the property is located. They are private agreements and are binding upon every owner in a subdivision. All future owners become a party to these agreements when they purchase property in deed restricted areas.
