All of this language is a bit dense, but essentially, anyone who has an agreement to improve property with you directly, or an agreement with another contractor who has such an agreement with you, can file a lien if left unpaid. This commonly includes contractors, subcontractors, and material suppliers.

For the most part, all contractors, subcontractors, laborers, materials suppliers, and equipment suppliers who provide labor or materials to a property in Texas are not required to have a written contract (a verbal agreement is sufficient) to qualify for the right to file a lien.

In order to have a valid mechanics' and materialmans' lien on a homestead in Texas, there must be a written contract between the original contractor and owner, signed by both spouses (if property is owned by a married coupled) and filed with the county clerk prior to any work being done on the homestead.

There are three general steps to file a mechanics lien in Texas: Fill out the appropriate Affidavit of Lien form. Deliver your lien form to the county recorder office. Serve your lien on the property owner.

In all cases, Texas requires that you send a separate pre-lien notice for each month you're not paid, or you will forfeit your right to file a mechanics lien for that month's work.

Texas contractors who contract directly with the owner do not need to send preliminary notice. However, on residential projects, the general contractor must give the owner a disclosure statement before signing the contract, and a written list of all the subs and suppliers intended to be used.

Is an Affidavit of Completion required in Texas? Short answer: No. An Affidavit of Completion can be filed by the owner or general contractor. It helps to establish the completion date for the project, as well as the filing deadline for liens on unpaid contractual retainage.

There are three general steps to file a mechanics lien in Texas: Fill out the appropriate Affidavit of Lien form. Deliver your lien form to the county recorder office. Serve your lien on the property owner.

Two notices are required in Subsections 114 and 115(b) of the ACA. First, subcontractors and material suppliers must send a notice to the owner 10 days prior to filing a lien, and this notice must state the amount owed and the person who owes the amount (Subsection 114).

Contractors can file a lien on a property without a written contract in most cases. However, if the project in question is on a residential homestead property, a written contract must be filed in the local property records and is required to enforce mechanic's lien filing rights.
