A dismissed case means that a case is closed without finding guilt. This means there are no convictions for the defendant in a criminal case by a court of law. However, a dismissed case does not prove that the defendant is factually innocent and could remain on the defendant's criminal record.

A case may be dismissed for want of prosecution for any of the following reasons: 1. Failure of Petitioner to request a setting or take other appropriate action after notice from the Clerk that the case has been pending without action for more than sixty days.

Voluntary and Involuntary Case Dismissals Most commonly, a defendant will file a motion to dismiss if they believe there is a lack of evidence, improper jurisdiction, a breach of the statute of limitations or if they believe the other party is not complying with a court order.

A party should file a request to reinstate the appeal as soon as possible after the Court of Appeal files a dismissal order. Check with your Court of Appeal to find out what the deadline is to file a request to reinstate the appeal in your case.

If a case is “reinstated” it is reopened after being dismissed. If your case was dismissed for want of prosecution, you can ask the judge to reopen your case by filing a Motion to Reinstate Case on Docket and Notice of Hearing (if you file by the deadline discussed below.) See Texas Rule of Civil Procedure 165(a)(4).

Rule 165a - Dismissal for Want of Prosecution 1. Failure to Appear. A case may be dismissed for want of prosecution on failure of any party seeking affirmative relief to appear for any hearing or trial of which the party had notice.

If you believe you received an unjust divorce settlement, you have a right to ask the court to revisit your case. However, a judge will only reopen a divorce settlement if you can prove there are exceptional and compelling circumstances.
