A notice of claim provision in a liability insurance policy requires the insured to promptly notify the insurer in the event that a claim is made against the insured.

The CNF is intentionally a comprehensive document as it needs to ensure a compensator is able to make important decisions about the accident, such as if the accident was caused by their insured's breach of duty or if the accident caused some injury to the claimant.

6.5 The statement of truth in the CNF must be signed either by the claimant or by the claimant's legal representative where the claimant has authorised the legal representative to do so and the legal representative can produce written evidence of that authorisation.

The Protocol promotes the practice of the claimant obtaining a medical report, disclosing it to the defendant who then asks questions and/or agrees it and does not obtain their own report. The Protocol provides for nomination of the expert by the claimant in personal injury claims.

7.32 There is a 35 day period for consideration of the Stage 2 Settlement Pack by the defendant (“the total consideration period”). This comprises a period of up to 15 days for the defendant to consider the Stage 2 Settlement Pack (“the initial consideration period”) and make an offer.

Claims notification is the process of informing an insurance company that a loss has occurred and that the policyholder intends to ask for money as a result. Losses are reported immediately, with generous reserves established within days or weeks of claims notification.

These are: Stage 1 – Notification. Your Solicitor/Lawyer will send a Claim Notification Form (CNF) to the defendant, which must be acknowledged within 1 working day. The Defendant must then provide a response to confirm if they accept liability or not.

6.11 The defendant must complete the 'Insurer Response' section of the CNF (“the CNF response”) and send it to the claimant within 15 days.
