Judicial System of Namibia The judicial system comprises the Supreme Court, presided over by a chief justice, the High Court, presided over by a judge president, and the lower and magistrates' courts. The Supreme Court serves as a constitutional court and a final court of appeal.

The judiciary of Namibia consists of a three-tiered set of courts, the Lower, High and Supreme Courts. Parallel to this structure there are traditional courts dealing with minor matters and applying customary law.

The federal court system has three main levels: district courts (the trial court), circuit courts which are the first level of appeal, and the Supreme Court of the United States, the final level of appeal in the federal system.

High Court Judges are assigned to one of the three divisions of the High Court – the King's Bench Division, the Family Division or the Chancery Division.

In terms of Article 79 of the Constitution, the Supreme Court of Namibia consists of the Chief Justice and additional Judges and is presided over by the Chief Justice. In terms of Article 78 the Supreme Court has inherent jurisdiction.

Namibia has a constitution dating from 1990 which has provisions providing that no person should be subject to arbitrary arrest and detention; that all persons accused of a crime are presumed innocent until proven guilty; and that no persons shall be subject to torture or to cruel, inhuman or degrading treatment or ...

In terms of Article 80 the High Court consists of the Judge President and additional Judges, presided over by the Judge President.

Mandate and power The Supreme Court regulates its own procedures and makes Rules of Court. A Supreme Court decision can only be reversed by an Act of Parliament that contradicts it, or by another ruling of the Supreme Court itself.
