A work permit certificate is required by state law, for the employment of children under sixteen (16) years of age AT ALL TIMES. There is no provision in the law for age certificates for children sixteen (16) and older. An age certificate can be issued upon request to verify the child's age.

Prior to employment, every child actor under age 14 (except those working as extras; see below) must have an authorization of employment from the TWC. To apply: fill out the application form available from the TWC's Labor Law Section (in Texas, call 800-832-9243; outside Texas, call 512-475-2670);

Youth 14 and 15 years old enrolled in an approved Work Experience and Career Exploration Program (WECEP) may be employed for up to 23 hours in school weeks and 3 hours on school days (including during school hours). The FLSA does not limit the number of hours or times of day for workers 16 years and older.

As a general rule, the FLSA sets 14 years old as the minimum age for employment, and limits the number of hours worked by minors under the age of 16.

What is required to obtain a work permit? The student must show proof of age at the time of issuance. Examples of proof of age include but are not limited to: birth certificate, Tribal ID, passport, and government issued identification.

Work Permits can be obtained at the school you are attending or from the Superintendent's office of the school district in which you reside, or from the New Mexico Department of Workforce Solutions office nearest you. Your parent or guardian must be with you at the time your work permit is issued.
