In certain cases of willful nonpayment of child support, the delinquent parent may go to jail for up to six months. Noncustodial parents who owe child support arrears equal to or more than four months of current support may be eligible to have their state-issued licenses suspended through the court process.

OCSE submits the names of delinquent parents to major Consumer Reporting Agencies (CRAs) when they owe at least $1,000 in child support or are two months in arrears, whichever happens first.

Parents should put their agreement in writing. Parents present this document to a judge, who may waive child support arrears. Courts will usually waive the arrears if it is in the child's best interest and results from a parent's lost job or special circumstances where they cannot make payments.

For one child, you take 17% of the parents' combined income, for two children you take 25%, for three children you take 29%, for four children you take 31% and for five children you take no less than 35% of the parents' combined income and this percentage amount represents the basic child support obligation.

Arrears Cap can put a limit on the amount of child support debt that a noncustodial parent owes to the government. The amount of arrears can be reduced to as low as $500. To qualify, noncustodial parents must owe child support debt to the NYC Department of Social Services (DSS).

New York has a 20-year statute of limitations. A parent must provide the child support they owe to the parent who was financially responsible for the child for 20 years after the date of default if they do not pay the total amount of child support they owe by the time the child turns 21.

Failure to comply with paying child support is a form of child neglect and in extreme cases over $10,000, should be guilty of a class E felony punishable in ance with the penal code.

A person who is convicted of willfully failing to pay child support in NY for the second time in five years can be charged with a felony offense. Otherwise, the person can be charged with a misdemeanor.
