California Revenue and Taxation Code (R&TC) Sections 18662 and 18664 require the withholding agent to provide a completed Form 592-B, Resident and Nonresident Withholding Tax Statement, to the payee to report the amount of payment or distribution subject to withholding and tax.

A lower tier PTE is an entity with California source income that has a PTE owner. If it withheld tax on behalf of its nonresident owners, it is required to file Form 592-PTE to allocate withholding to each nonresident owner, in ance with each nonresident owner's interest in the entity.

Purpose. Use Form 592-F to report the total withholding for the year on foreign partners or members under California Revenue and Taxation Code Section 18666. Form 592-F is also used by pass‑through entities to pass through withholding credit to their foreign partners or members.

Use Form 592‑Q to remit withholding payments reported on Form 592-PTE. Compute the amount of resident and nonresident withholding tax to be withheld by applying a rate of 7% or a reduced amount as authorized in writing by the FTB.

Tax withheld on California source income is reported to the Franchise Tax Board (FTB) using Form 592. Form 592 includes a Schedule of Payees section, on Side 2, that requires the withholding agent to identify the payees, the income amounts, and the withholding amounts.

A pass-through entity should use Form 592 if: It is reporting withholding from payments made to domestic nonresident independent contractors or domestic nonresident recipients of rents, endorsement income, or royalties.
