Texas law says, “A person may scatter cremated remains over uninhabited public land, over a public waterway or sea, or on the private property of a consenting owner. State law allows you to dispose of cremated remains by scattering the ashes on private property (assuming you have the consent of the property owner) or having them interred at a cemetery. Texas law prohibits cremating any dead human body within 48 hours after death. A body cannot be cremated immediately following death without a waiver.
