New Jersey law classifies certain drugs and compounds as a “controlled dangerous substance,” or CDS. Any drug classified as a CDS is considered susceptible to abuse and is regulated by the state. A CDS cannot be possessed, sold, or distributed except in certain circumstances, such as for registered medical use.

When up to three separate prescriptions for a total of up to a 90-day supply of a Schedule II controlled substance are issued to a patient by a physician pursuant to 45:9-22.1 9 ( P.L. 2009, c. 165 ), a pharmacist shall fill such prescriptions.

With some exceptions, a drug charge for possession or distribution of a controlled substance is typically a felony in New Jersey. To gain a conviction for CDS possession, the prosecutor must prove that you had physical possession or constructive possession of a drug or substance listed on one of the five schedules.

Possession of any CDS from Schedule 1 - V - other than marijuana and hashish- is a felony crime in the third degree. Most common drugs in New Jersey court cases includes cocaine, heroin, , and ecstasy. Third degree felonies are punishable by 3-5 years in prison and a fine of up to $35,000.

New Jersey Law: Straight Possession of Drugs ing to the state's drug laws, possession of CDS is a motor vehicle violation, but when the substance involved is marijuana and the amount doesn't exceed 50 grams, it is a “disorderly persons offense”; this is a highly common charge in the state of New Jersey.
