Franchise Tax Every corporation that files form TC-20 must pay a minimum tax (privilege tax) of $100, regardless of whether or not the corporation exercises its right to do business.

A corporate franchise tax is a tax imposed by a state on corporations, LLCs, and partnerships. This tax is assessed to these companies for the privilege of either doing business in the state or incorporating their business in that state. Like income taxes, typically franchise taxes are assessed annually.

Here's how it works when you authorize a PTE to pay a tax on behalf of pass-through entity taxpayers who are individuals. Pass-through entities in Utah pay the standard state income tax rate which is 4.95%, which is the same as the individual state income rate.

If you have or are required to have a Utah Sales and Use Tax License, you must report and pay the use tax on your Utah Sales and Use Tax Return (Form TC-62S or Form TC-62M).

Utah imposes two types of taxes on corporate income: a franchise tax measured by net income and a direct income tax. The franchise tax is imposed on all nonexempt corporations, foreign and domestic, for the privilege of exercising their corporate franchise or doing business in Utah.

Corporation income is taxed at a flat rate of 4.95% with a minimum amount of $100. This applies only to C corporations and limited liability companies that have elected to be federally taxed as corporations. The Utah business tax rate for pass-through entities is the standard state income tax rate, which is also 4.95%.

Utah Tax Rate: The 2022 Utah Legislature passed SB 59, lowering the state corporate income tax rate from 4.95 percent to 4.85 percent. Payroll Protection Program Loan Addback: In certain situations, you must add to your income the amount of PPP grants or loans forgiven in 2022.

A corporation does not have to make estimated tax payments the first year it is required to file a Utah return if it makes a payment on or before the due date, without extension, equal to or greater than the minimum tax.
