Florida law prevents you from cutting down a neighbor's tree or even entering a neighbor's property without the owner's permission. However, utility companies are excused from this prohibition under Section 163.3209 of the Florida Statutes.

Did you know some trees are protected by law? That's right! Mangroves, sea grapes and some wetland vegetation are protected by statute in order to protect Florida's shores and water resources. Other trees such as large oaks may be protected by your local municipality.

A tree removal or encroachment permit IS required if: The tree is on residential property and the property owner doesn't have documentation from an arborist certified by the International Society of Arboriculture or a Florida licensed landscape architect that the tree presents a danger to persons or property.

What do I need to do now? In ance with Section 11.4 of the Land Development Code, a Tree Removal Permit must be submitted and a fee twice that of the regular permit fee as outlined in Section 11.18 Violations and Penalties is also due with the permit application.
