In certain zoning districts, conditional uses are permitted subject to the granting of a Conditional Use Permit (CUP). Because of their unusual characteristics, conditional uses require special consideration so they may be located properly with respect to their effects on surrounding properties and uses.

The Conditional Use Permit (CUP) is the procedure in which a use is reviewed for compliance with the comprehensive plan, availability of services, compatibility, and possible adverse impacts upon neighboring properties.

Any property owner entitled to specific notice pursuant to the provisions of this subsection shall have a right to participate in public hearings before a planning commission, planning and zoning commission or governing board.

Conditional Use Permit A CUP is granted to a specific applicant for a specific use at a specific location and cannot be transferred to subsequent owners or operators, nor may it be “carried over” to a new property.

Conditional Use Permit form. $2,500 at cost deposit for all districts. $4,000 deposit to approve: an outdoor recreation facility, sanitary landfill, flight strip, heliport, cemetery, church, or school.

What is a Conditional Use? A “Conditional Use” is a land use that has unique characteristics or negative effects that may not be compatible in an area without conditions to mitigate or eliminate the detrimental impacts.

A conditional use permit is an authorization which allows a landowner to use his property in a manner compatible with the zoning district in which it is located, provided he demonstrates compliance with all standards and criteria enumerated in this Resolution and specified by the Board.

A Conditional Use Permit is an entitlement that runs with the property. Depending on the complexity and completeness of the project, the process generally takes about 3 to 6 months from date of application submittal. Approval is not guaranteed and you may be required to modify your proposal.
