Temporary guardianships: In effect for 6 months or less, temporary guardianships are often used when a current guardian needs to be replaced because (s)he is not promoting the ward's best interests. In these situations, the courts will name a temporary guardian.

A Colorado parental (minor child) power of attorney grants a relative or close friend the ability to make decisions and care for a person's children on their behalf should they be away and unable to make decisions for them. This form is only valid for a maximum of 12 months.

When a child has more than one legal guardian, this arrangement is called a co-guardianship. Co-guardians are people who may equally share roles in a child's life, but they can also serve roles in a child's life that don't overlap.

Under Colorado law, a guardian is entitled to compensation for their services. However, it is not automatic. Here are some things to keep in mind: The hourly rate must be deemed “reasonable”.

You must be at least 21 years old to be the guardian for a minor. You can ask the court to name you as the guardian, or you can ask the court to name someone else who is at least 21 years old. You can be the guardian for a minor who lives in Colorado even if you live in another state.

You must mail or hand-deliver a copy of JDF 835 Petition for Termination of Guardianship - Minor (and any attached information) to the minor (if the minor is at least 12 years old), and to all other interested persons.

There are no "wards of the state" in CO. There is no public office at the state level dealing with issues of guardianship. Instead, it is passed to county departments of human/social services; the counties include it in their Adult Protective Services divisions AT THEIR DISCRETION.

§ 15-14-105. A parent or guardian of a minor or incapacitated person, by a power of attorney, may delegate to another person, for a period not exceeding twelve months, any power regarding care, custody, or property of the minor or ward, except the power to consent to marriage or adoption.
