An immediate and present danger of domestic violence, including danger to the child's pet, stalking, or sexual assault to a child shall constitute good cause for purposes of this section.

If you have an order of protection, the police can arrest your abuser if that person violates the order. Violating an order of protection is a class A misdemeanor. You do not have to pay anything and you do not need an attorney to get an order of protection.

“Ex parte” means that the order is issued without prior notice to the abuser and without the abuser being present. The temporary order will protect you from the time it is granted until your full court hearing takes place, usually within 30 days.

An ex parte protective order is a temporary protective order issued by the court. Any person who violates any provision of the Order of Protection has committed a crime, specifically a Class A Misdemeanor, the punishment for which is up to a $1,000 fine and/or up to one (1) year in jail. The Judge issuing the Order can also punish for Contempt of Court.

Go to court on the hearing date listed on the ex parte order of protection or summons. If the petitioner does not appear in court for the hearing, the case will be dismissed.

Under the Missouri Child Protection Orders Act, Sections 455.500 through 455.538, RSMo, a person may seek an order of protection on behalf of a child (person under 17 years of age unless otherwise emancipated) who has been the victim of child abuse, sexual assault, or stalking.
