Can Non-Resident Aliens Work in the U.S.? Non-resident aliens can work in the United States after they have been authorized. They can become authorized by filling out Form I-9, Employment Eligibility Verification. This form confirms the alien is who they say they are and is eligible for employment.

AEP Requirements: Duly notarized application form; Letter of request sent to DOLE; Secretary's Certificate electing foreign national to position (for non-resident foreign nationals with elective positions); Authenticated passport with current visa; Photocopy of Mayor's Permit; and. Photocopy of Business Permit.

An alien who stays in the Philippines for less than 2 years is considered a non-resident alien. There are two classifications of a non-resident alien: engaged in trade or business in the Philippines. not engaged in trade or business in the Philippines.

An Alien Employment Permit (AEP) authorizes a foreign national to work in the Philippines. Though not a work permit, AEP is an important legal document required to secure a work visa in the country. Some foreign nationals are exempted from obtaining an AEP.

Foreigners or non-resident aliens are required to obtain an alien employment permit (AEP) prior to working in the Philippines. They are prohibited from transferring employment without prior approval from the DOLE Secretary. An employment contract is void if there is no alien employment permit.

The original must be produced for authentication purposes only. The initial government fee for a one (1) year AEP is Eight Thousand Pesos (P8,000.00). An additional Three Thousand Pesos (P3,000.00) should be paid for every additional year or a fraction thereof but should not exceed five (5) years.
