Tenants sign a contract containing terms that bind them to certain obligations under the lease. The lease agreement is between the landlord and tenant only. Occupants are authorized to reside in the property with the landlord's permission.

Terminating without a reason Give a minimum 14-day termination notice. The termination date in the notice can be the last day of the fixed term or up to 14 days after. You have to give this notice before your fixed-term agreement ends.

The landlord can give you 30 days notice to end your fixed term agreement. The last day they can give you 30 days notice is on the last day of your fixed-term agreement. You can leave at any time before the date on the notice, but you will have to pay the rent until the end of the fixed term.

The fact that the terms of the lease has come to an end does not mean that you have to leave the property. Unless you or your landlord takes specific steps to end the agreement under the lease, it will simply continue on exactly the same terms. You do not need do anything unless you receive a notice from your landlord.

A fixed-term agreement is for a specified period (e.g. 6 months). A periodic agreement is one where the fixed-term has expired or no fixed term is specified. If a termination notice is posted to you, the landlord/ agent must allow an extra 7 working days for delivery.

Under AB 1482, landlords are limited to increasing rent by no more than 5% plus the local CPI (inflation rate) or 10%, whichever is lower. The local inflation rate is determined by the California Consumer Price Index (CCPI), which is released annually by the California Department of Finance.

If your lease has expired and doesn't include an option to renew, the landlord doesn't have to renew the lease. However, most leases give the tenant an opportunity to 'hold over' the lease and stay in the shop on a month-to-month basis at the end of a fixed term.

The owner must give written notice of renewal by mail or personal delivery not more than 150 days and not less than 90 days before the existing lease expires. A failure of the tenant to respond within 60 days of the offering may lead to eviction proceedings.
