Child Maltreatment Defined Neglect can also be further unpacked into four addi- tional subcategories, which include physical neglect, emotional neglect, medical neglect, and educational neglect. We review each of these in more detail below.

What is neglect? A child is neglected if the child does not receive proper care, supervision, or discipline, from the child's parent, guardian, custodian, or caretaker; or the child has been abandoned. A child is neglected if the child lives in an environment injurious to the child's welfare.

Once a social worker has completed the investigative assessment, they will determine whether the allegations of abuse or neglect are substantiated or not. This can take weeks or months but usually last about 45 days.

There are four main categories of child abuse: physical abuse, emotional abuse, sexual abuse and neglect.

Within the minimum standards set by CAPTA, each State is responsible for providing its own definitions of child abuse and neglect. Most States recognize four major types of maltreatment: physical abuse, neglect, sexual abuse, and emotional abuse.

“A parent or caregiver of a child less than 16 years of age whose willful act or grossly negligent omission in the care of a child shows a reckless disregard for human life” may be charged with a Class G felony if the child sustains serious physical injury. A Class G felony is punishable with 8 to 47 months in prison.

North Carolina General Statute 7B-101 defines: • Physical Abuse; • Sexual Abuse; • Emotional Abuse; • Neglect; and • Dependency. The law applies to any juvenile under 18 years of age.

Both the United States Constitution and the South Carolina Constitution guarantee against unreasonable searches and seizures and unreasonable invasions of privacy. You have a right to legal representation at all stages of a DSS action, including the investigative stage.
