The comprehensive health care reform law enacted in March 2010 (sometimes known as ACA, PPACA, or “Obamacare”).

Here are some basics about how the rule works: Large employers can be penalized if they don't offer health coverage to all full-time employees and their dependents. “Full time” is defined as at least 30 hours per week on average. The coverage must be affordable, as defined by the law.

In summary, it is not necessary under federal laws to give equal benefits to all employees, but an employer should base benefit eligibility on tenure, full- or part-time status, exempt/nonexempt status, job group or even department. An employer must exercise due diligence to ensure its benefits are not discriminatory.

The employer mandate requires employers with 50 or more full-time (or full-time equivalent) employees to provide coverage that is affordable, provides minimum essential coverage, and meets minimum value requirements for 95% of their full-time employees.

Large Group Health Insurance Plan A large group health plan, in most states, is group medical insurance that covers an employer or association with 51 or more employees. Four states require large group health plans to have at least 101 employees: California, Colorado, New York, and Vermont.

Employer mandate overview. Generally, employers must offer health insurance that is affordable and provides minimum value to 95% of their full-time employees and their children up to the end of the month in which they turn age 26, or be subject to penalties. This is known as the employer mandate.
