The IHT435 is an inheritance tax form used in conjunction with the main IHT400 return for deceased estates. It is required by HMRC when the personal representatives are claiming the residence nil rate band (RNRB) on behalf of the estate.

The RNRB is only available when a property (or other assets when downsizing provisions apply) included in the deceased's estate is left to direct descendants. The estate can claim the RNRB if the property is left as a specific bequest to children and grandchildren.

For RNRB to apply, the home must be 'closely inherited'. In general this means that the property must be inherited by a child of the deceased, or by a remoter lineal descendant of the deceased (e.g. the grandchild, great grandchild, or other child of a child of a child etc.).

The NRB has been fixed at £325,000 since the tax year 2009 to 2010. The RNRB was introduced in the tax year 2017 to 2018, starting at £100,000 and increasing by £25,000 each year until reaching £175,000 in 2020 to 2021. The taper threshold has been set at £2 million since the RNRB was introduced.

IHT436 - Claim to transfer any unused residence nil rate band.

For IHT there is a tax threshold, known as the nil rate band, and below this limit you pay no tax as the rate is set at 0%. For 2022/23 the basic threshold is £325,000. The rate is then usually 40% on anything above this amount.
