So long as the binding death benefit nomination is valid, the Trustee is bound to follow it. A non-binding death benefit nomination is a written request made by you that suggests to the Trustee the beneficiaries that may receive your benefit in the event of your death.

the nomination must be in writing, signed and dated by the member and witnessed by two adults (who are not beneficiaries) who must declare that the nomination was signed in their presence; a member giving notice may amend, revoke or affirm the notice after it is made; the nomination lapses after three years.

A BDBN is a notice given by a member to the trustee of their super fund which imposes a direct duty on the trustee to pay their death benefits in ance with their wishes specified in the notice. A BDBN can be useful where there is some doubt that the member's wishes will be carried out upon death.
