California Nonresident Tuition Exemption commonly known as AB 540, exempts certain students from paying nonresident tuition (higher than resident tuition) and/or allows them to apply and receive state aid at certain California public and private colleges.

AB 540/ SB 68 / SB 1141 applies only to public community colleges and universities in California.

The Non Resident Supplemental Tuition or NRST ($7,500 per term or upto $15,000 per year) is a financial penalty beyond Year 6 that disproportionately targets international students and poses economic burdens on already precarious noncitizen student workers.

Under California law AB 540, certain nonresident students are exempt from paying nonresident supplemental tuition. If you're granted an AB 540 exemption, you will be charged in-state tuition and fees, and not the supplemental tuition charged to nonresidents.

Assembly Bill 540 was signed into law in October 2001 and allows eligible undocumented, legal permanent resident and U.S. citizen students to pay in-state tuition at public colleges and universities.

Under California law AB 540, certain nonresident students are exempt from paying nonresident supplemental tuition. To be eligible for this exemption a student must meet a combination of California time and enrollment requirements as well as degree or unit attainment.

Schools' reasoning for charging higher out-of-state tuition is because non-resident students' come from families who haven't paid tax dollars to the state, and thus to the school. Out-of-state tuition brings in more revenue to the school, which can be used for a variety of purposes.
