The statutory period preceding the filing of the application is calculated from the date of filing. Once 4 years and 1 day have elapsed from the date of the applicant's return to the United States, the period of absence from the United States that occurred within the past 5 years is now less than 1 year.

3 Years of Continuous Residence. The spouse of a U.S. citizen residing in the United States must have continuously resided in the United States as an LPR for at least 3 years immediately preceding the date of the filing the application and up to the time of the Oath of Allegiance.

The filing fee for Form N-470 is $355. NOTE: The filing fee is not refundable, regardless of any action USCIS takes on this application.

While the normal limit is a year, you can stay longer and still preserve your US citizen if you are a military service member, Government employee, or meet any other criteria discussed above i.e., work for a US multinational or you proactively preserve residence.

USCIS will count the day that an applicant departs from the United States and the day he or she returns as days of physical presence within the United States for naturalization purposes.

Definition. A bright-line, common law rule that a person cannot be convicted of homicide for a death that occurs more than a year and a day after his or her act(s) that allegedly caused it. The rule arose from the difficulty of determining cause of death after an extended period of time.

N-470, Application to Preserve Residence for Naturalization Purposes. Use this form if you are a lawful permanent resident who must leave the United States for a period of one year or longer to engage in qualifying employment and you want to preserve your residence to pursue naturalization.

If you stay outside of the United States for 1 year or more and did not apply for a reentry permit before you left, you may be considered to have abandoned your permanent resident status. If this happens, you may be referred to appear before an immigration judge to decide whether or not you have abandoned your status.
