Principles of the Adults With Incapacity Act The Act aims to protect people who lack capacity to make particular decisions, but also to support their involvement in making decisions about their own lives as far as they are able to do so.

The Adults with Incapacity (Scotland) Act 2000 creates provisions for protecting the welfare of adults who are unable to make decisions for themselves because of a mental disorder or an inability to communicate. It allows other people to make decisions on behalf of these adults about things like: arranging services.

The Act provides a legal framework for people to get permission to make such decisions on someone else's behalf. The first thing to remember is that the five key principles outlined earlier must be followed in regards to any decision.

4 Power of Court of Session or sheriff with regard to nearest relative. (c)no person shall, during the continuance in force of the order, exercise the functions of the nearest relative. (2)An order made under subsection (1) shall apply only to the exercise of the functions under this Act of the nearest relative.

Principle 5: Less restrictive option Someone making a decision or acting on behalf of a person who lacks capacity must consider whether it is possible to decide or act in a way that would interfere less with the person's rights and freedoms of action, or whether there is a need to decide or act at all.

The Act covers people whose incapacity is caused by a mental disorder such as dementia, learning disability, acquired brain injury, severe mental illness or personality disorder. It also covers people who are unable to communicate due to a physical condition such as a severe stroke or sensory impairment.

The Adults with Incapacity (Scotland) Act 2000 defines Adults with Incapacity (AWI) as those adults (people aged 16 or over) who lack capacity to take some or all decisions for themselves because of a mental disorder or an inability to communicate.

16 Creation and exercise of welfare power of attorney (2)In this Act a power of attorney granted under this section is referred to as a “welfare power of attorney” and an individual on whom such power is conferred is referred to as a “welfare attorney”.
