In Maryland, there is no rebuttable presumption in favor of shared custody–whether physical or legal. Furthermore, neither parent is presumed to have a greater right to custody over the other, and there is no preference for one gender over the other.

Either of the separated parents may petition the Circuit Court in Washington DC for custody of a child. If the parties cannot agree about who should have custody, the court will grant custody either solely to one of the parents or shared between parents.

In the District of Columbia, there is also no specific legal age for a child to express an opinion on custody. Courts will consider, “(t)o the extent feasible, the child's opinion of his or her own best interests in the matter.”

The D.C. courts presume that it's in the best interests of the child for the parents to have joint custody, except where the court finds that there's an instance of the following: Child abuse; Child neglect; or. Parental kidnapping.

However, a judge can award sole custody if he or she decides that joint custody is not in a child's best interest, or if there has been child abuse, child neglect, parental kidnapping, or domestic violence.
