You can reinstate your patent application up to 12 months after the application is first deemed to be abandoned.... Write your request to the Commissioner. A request for reinstatement is made by letter. ... Submit your letter. ... Wait for a response.

If the applicant fails to file a reply to the objections, the application is deemed to be abandoned. In the USPTO, an abandoned patent application can be revived by filing a petition for revival of the abandoned application.

It is possible for the patent owner to reinstate the patent, if it expires, by paying a surcharge in addition to the maintenance fee. It's also possible for the patent holder to put the expired patent up for sale and sell the patent and their rights to someone else who could renew the expired patent by paying the fees.

File your petition to revive no later than two months after the issue date of your Notice of Abandonment. If you didn't receive the Notice of Abandonment, file your petition within two months of learning of the abandonment and no later than six months after the abandonment date in TSDR.

Procedure to Reinstate For the patent to be reinstated, the USPTO must accept the explanation of the business. In cases in which the late payment of maintenance fees is unintentional, the petition must be brought within two years of the expiration date.

This program provides a fast-track review for cancer immunotherapy-related patent applications without the need for applicant to pay a petition fee. Under this program, patent applications pertaining to cancer immunotherapy are advanced out of turn for examination, resulting in their accelerated review.
