30-day letter (Notice to Quit) for contractual issues. This notice applies if the tenant is in violation of the lease/rental agreement. The landlord gives the tenant written notice to vacate the premises within 30 days.

A landlord can simply give you a written notice to move, allowing you 30 days as required by Virginia law and specifying the date on which your tenancy will end. (The rental agreement may provide for a different notice period.)

For month to month tenants, or tenants coming to the end of a rental agreement, the landlord must give at least 30-day notice to vacate on or before the first of the month ending on the last month.

A landlord and tenant can enter into a month-to-month lease through a written contract or oral agreement. It does not have to be written. Once the lease is active, both parties are given full rights under Virginia landlord tenant law.

Under Virginia law, the landlord may not shut off utilities, lock you out of the rental unit, or evict you without giving notice and going to court.

A landlord shall not charge a tenant for late payment of rent unless such charge is provided for in the written rental agreement. No such late charge shall exceed the lesser of 10 percent of the periodic rent or 10 percent of the remaining balance due and owed by the tenant.

If you simply pay rent once a month, then it is called a month to month tenancy and starts again each month. Either you or the landlord can end the tenancy by giving written notice at least 30 days before the next rent payment is due.

The landlord or the tenant may terminate a month-to-month tenancy by serving a written notice on the other at least 30 days prior to the next rent due date, unless the rental agreement provides for a different notice period. The landlord and the tenant may agree in writing to an early termination of a rental agreement.
