On March 7, 2023, Governor Whitmer signed Public Act 4 (formerly HB 4001), amending the 2011 tax placed on retirement income and expanding Michigan Working Families Tax Credit.

Retirees may subtract: all qualifying pension benefits received from federal or Michigan public sources. Public sources of pension income derived from other states is limited to private retirement maximums. qualifying private retirement and pension benefits are adjusted for inflation.

You will qualify for full retirement at age 60 with at least 10 years of service, or age 55 with 30 years of service. (Exception: If you are an unclassified legislative branch, executive branch, or judicial branch employee, you are vested for a full retirement benefit at age 60 with 5 years of service.)

Married couples filing a joint return should complete Form 4884 based on the year of birth of the older spouse. Military and Michigan National Guard pensions, railroad retirement benefits and Social Security benefits are exempt from tax and should be reported on the Schedule 1, line 11 or line 14.

The legislation, coined the “Lowering MI Costs” plan by Democratic lawmakers, overhauls tax changes made by then-Gov.

House Bill 4001, sponsored by State Representative Angela Witwer (D-Delta Township), amends the Income Tax Act to phase out the retirement tax over four years and ultimately deliver an average of $1,000 to 500,000 households. The bills also equalizes the exemption on both public and private pensions.
