The U.S. Congress passed the National Organ Transplant Act (NOTA) in 1984. Congress passed (NOTA) to address the organ donation shortage and improve the organ matching process. The act established the Organ Procurement and Transplantation Network (OPTN) to maintain a national system to match organs and individuals.

Utility, justice, and respect for persons are three foundational ethical principles that create a framework for the equitable allocation of scarce organs for transplantation.

Guiding Principle 5 Cells, tissues and organs should only be donated freely, without any monetary payment or other reward of monetary value. Purchasing, or offering to purchase, cells, tissues or organs for transplantation, or their sale by living persons or by the next of kin for deceased persons, should be banned.

The CTO Regulations require that source establishment and establishments that distribute or import cells, tissues or organs register with Health Canada. Establishments that only retrieve CTO, only import for transplant, or only transplant do not have to register.
