3-Day Notice The first kind of New York Eviction Notice is called a “Demand for Rent.” A 3-Day Demand for Rent is required under the New York eviction process in cases of nonpayment of rent.

Non-payment Building owners must notify the tenant that rent is late, what the balance is, and that, if not paid, the tenant will be evicted. Three days after notice is given or oral demand for the rent is made, the owner may file a nonpayment proceeding in Housing Court and serve papers on the tenant.

File a complaint with the court, including the facts of the case and how much money is owed. Once the complaint is filed, you must serve the tenant following the instructions provided by small claims court. Often, you may do this by hand-delivering it or sending it by certified mail.

If the rent is not received within 5 days of when it is due, then your landlord must deliver it by certified mail. Late notice #2: This is the 14 day rent demand. After this is delivered, your landlord must wait at least 14 days before starting an eviction case in court.

A nonpayment case is brought by the landlord to collect unpaid rent. A tenant may be evicted for non-payment of rent....Or, the landlord may use forms of his or her own, or may buy the following forms at a legal stationary store: Petition. Notice of Petition. Service copies. Postcard.

14 DAY NOTICE: The 14 day notice must state the amount of the rent due and the period of time for which the amount is due, together with a demand that the total amount be paid within 14 business days after service of the notice. The date of service, Saturdays, Sundays and holidays are excluded.

Step 1: File a non-payment petition that details the missed dates or rental periods and the total amount owed. Step 2: Have the petition notarized. Step 3: Submit the petition and other required forms to the Landlord-Tenant Clerk's Office. Step 4: Pay the fees and claim a court index number.

A summary proceeding is an expedited process through which a landlord may evict a tenant. In New York, summary proceedings are governed by strict statutory guidelines that concern, among other things, notice, service, and the right to a jury trial.
