removal. n. 1) the change of a legal case from one court to another, as from a state court to federal court or vice versa based on a motion by one of the parties stating that the other jurisdiction is more appropriate for the case.

You can do this by appearing at the District Court's information window (with appropriate picture identification) and ask to fill out a CHANGE OF ADDRESS NOTICE (DC-324). You may also notify the court by mail by printing this form and completing the information legibly, accurately, and completely.

So why would a defendant want to remove the case to federal court? Well, removing a case may alleviate certain concerns about prejudice or bias against an out-of-state defendant. Removal also allows the parties to use federal procedural rules instead of state rules.

The removing party shall file the notice of removal with the clerk of the state court where the action was initiated. The state court notice must include copies of all state court pleadings and orders that were served on the removing party, as well as the federal district court removal papers.

Deadlines. Once a case is served, the defendant has 30 days to remove it to federal court. If a case is not initially removable, but becomes removable later—due to amendment, joinder, or otherwise—this typically triggers the 30-day deadline from the date of the operative event.

Notice of removal: A notice of removal is signed by the defendants and filed in federal court to begin the process of transferring the civil action from state court to federal court. In certain cases, the defendant may wish the case to be heard by a federal, rather than state, tribunal.
