Florida divorce law provides a process called a 'Simplified Dissolution of Marriage. ' Couples can use this to get a quick divorce, about 30 days from filing to finalization, as long as they have complete agreement on the terms of the divorce and it's uncontested.

There are several mandatory forms that must be filed in cases with minor children, such as a Financial Affidavit and a Uniform Child Custody Jurisdiction and Enforcement Act affidavit. You must also attend, in person, an approved parent education and family stabilization class.”

Petition for dissolution of marriage. There are separate forms for the simplified procedure (Form 12.901(a), above), and for cases with dependent or minor children (Form 12.901(b)(1)), with property but no children (Form 12.901(b)(2)), and with no property or children (Form 12.901(b)(3)).

The length of time it takes to get a divorce in Florida depends on the type of divorce. A simplified divorce may take 30 days. An uncontested divorce may range from 4 to 6 weeks. A contested divorce may take up to six months, a year, maybe several years depending on the disputes within the marriage.

An uncontested divorce in Florida means that the parties agree on all issues such as division of property and debts, alimony or not, child support, visitation if applicable, and responsibility for attorney fees. There is nothing left for the judge to decide.

In Florida, there is no difference between a dissolution of marriage and a divorce. Under Florida law (Florida Statutes Chapter 61), “dissolution of marriage” is simply the legal term used to describe divorce.

All that is required is to allege there are irreconcilable differences. For example, a spouse does not have to provide evidence of adultery or domestic violence to obtain a divorce. If both of you agree on the divorce terms, you can file for an uncontested divorce.

The regular dissolution process begins with a petition for dissolution of marriage, filed with the circuit court in the county where you and your spouse last lived together or in a county where either party resides. Either spouse may file for a dissolution of marriage.
