A Con/Arb is a combination of the conciliation and arbitration processes. It has the effect that the arbitration hearing will take place immediately after conciliation on the same day. This, in turn, means that the dispute will most likely be resolved or finalised within 30 days after it has been referred.

Step 6: Usually the first meeting is called a conciliation hearing. Only the parties, trade union or employer organisation representatives (if a party to the dispute is a member) and the CCMA Commissioner will attend. The purpose of the hearing is to reach an agreement acceptable to both parties.

Conciliation is a process where a commissioner meets with the parties to a dispute and explores with them ways to settle the dispute by agreement.

Con-arb simply means that that the arbitration hearing is scheduled to take place straight after the conciliation hearing, on the same day, in the event that the parties are not able to settle the conciliation hearing.

If you have decided to lodge a dispute, you need to complete a CCMA case referral form, also known as a LRA Form 7.11. These forms are available from the CCMA offices, DOL offices and the CCMA website....Disputes Dismissal; Wages and working conditions; Workplace changes; Or discrimination.

Conciliation Court hearings do not involve a jury. Instead, a Judicial Officer (Judge or Referee) decides the outcome of the case. In Conciliation Court, witnesses and evidence are presented at the hearing. Bringing a case in Conciliation Court can be less expensive and simpler than filing in District Court.

Collective conciliation is used to resolve disputes about: annual pay reviews. other pay issues. contract terms and conditions. changes in working practices. discipline and dismissal, if an employee representative or a group of people are involved. redundancy consultation and redundancy selection. trade union recognition.

The CCMA's compulsory statutory functions are to: Conciliate workplace disputes. Arbitrate certain categories of disputes that remain unresolved after conciliation, establish picketing rules. Facilitate the establishment of workplace forums and statutory councils.
