When you receive a handicap permit, you're the only one who is legally allowed to use it. You can use it as either the driver or passenger of a vehicle, but you must be present when the placard is displayed.

One must knowingly misuse or allow someone else to misuse a placard in order to violate the statute. Unlawful use of a disability placard can be treated as either an infraction or a misdemeanor. If this charge is reduced to an infraction, the penalty would be a court fine between $250 and $1,000.

Is my disabled parking permit valid in other states? It's generally accepted that your handicap parking permit is valid in all 50 states across the country. So, you should be permitted to park in any designated handicap parking place, no matter what state you find yourself in.

NOTE: A parking placard or plate is ONLY valid when being used by the person with the disability or someone who is driving the person with the disability. It is a violation of state law to use the placard or plates for a disabled parking spot without the person with the disability in the vehicle.

A Universal Medical Evaluation/Progress Report (form #VS-113) must be completed and signed by a licensed physician, certified physician assistant, or licensed advanced practice registered nurse. The Department will file the form for future reference and issue the placard or plate if the applicant is found to qualify.
