Judicial subpoenas are issued by a judge, clerk, or any other officer of the court, including the attorney in a case (CPLR 2302(a) and Practice Commentary C2308:1 to McKinney's CPLR 2308).

Essentially, a subpoena, which literally means 'under penalty', requires one to inform under oath (testify) on the facts that are at issue in a pending case. A subpoena is typically requested by an attorney on behalf of the court and issued by a court clerk, notary public or justice of the peace.

Serve a So-Ordered Subpoena in New York City Submit the subpoena to the Court Clerk's Office, who will forward it to the judge. Retrieve the subpoena once it is signed. Ensure that an original HIPAA authorization accompanies the subpoena (if medical records are requested). Serve the subpoena on the recipient.

(d) Subpoenas by attorneys. An attorney appearing for a party may issue subpoenas or subpoenas duces tecum returnable at a hearing before an administrative law judge.
