Pursuant to Florida Statutes Chapters 718 and 720, an Association may adopt reasonable written rules governing the frequency, time, location, notice, records to be inspected, and manner of inspections, but cannot require a unit owner to state a reason for the inspection.

Typically, homeowners will need to submit a written request to the HOA board, the body responsible for maintaining these records. Though, some associations will accept a phone call or a simple email. Remember to write your request using a friendly yet professional tone instead of a demanding one.

Many associations now have these posted on the public area of their websites well. This is done based upon a title search and will (should be anyway) accurate. They typically have these on hand, in the case of a condominium, as Florida law requires a Buyer of a Condo to be provided with these, should they be requested.

The records of the association shall be made available to a unit owner within 45 miles of the condominium property or within the county in which the condominium property is located.

Residential communities have a legal obligation to retain records pertaining to condo/HOA business. That includes things like governing documents, maintenance records, insurance records, architectural plans and annual budgets.

Central to these governing documents are the Covenants, Conditions, and Restrictions, commonly referred to as CC&R. CC&R are the guidelines that govern property use, architectural standards, maintenance responsibilities, and even pet policies.
