What's a Flood Disclosure Law? Flood disclosure laws require sellers to provide written disclosure of any flooding or water damage they are aware of. This disclosure might also denote whether the buyers will be required to carry a flood insurance policy.

Texas Tenant Laws: Security Deposits, Repairs, and More If your home becomes uninhabitable, you may be able to terminate your lease early or make the repairs and deduct the cost from your rent.

If the landlord fails to disclose and the tenant suffers substantial property damage due to flooding, the tenant may end the lease. Lease termination must be in writing and given to the landlord no later than 30 days after the damage occurred.

A court order directing the landlord to take reasonable steps to repair the condition. A court order that reduces the tenant's rent ing to the decreased rental value resulting from the condition. A judgment for one month's rent plus $500. A judgment for the amount of the tenant's actual damages.

Your landlord should make a diligent effort to repair the problem within a reasonable time after receipt of the notice. The law presumes seven days to be a reasonable time, but the landlord can rebut this presumption.

You can look this up on FloodPro, an online tool that shows floodplain maps, models, rainfall amounts, elevation certificates and floodplain map revision information. Questions? Call 512-974-2843 or send an email.

You can submit a complaint online, or you can call their office at (512) 463-2642 or toll-free (Texas only) at (888) 452-4778.

The Texas law, which took effect Jan. 1, is the first to require landlords to disclose both the flood history of a rental unit and whether it's in an area that has a significant risk of flooding. Only five other states require flood disclosure for rental units.
