New York is a “no-fault” insurance state, which means that insureds are generally reimbursed by their insurance company for damages regardless of who was responsible for causing the accident. Insureds can be reimbursed for medical costs and other losses that might surface after the accident.

No-Fault will pay 80% of your salary up to a maximum of $2000 per month, and for a maximum of three years. If you were a bigger wage earner than that, or you are out of work for longer, your lawyer will have to claim the additional lost income from the at-fault driver/car owner's insurance.

No-fault insurance provides a minimum of $25,000 per person and $50,000 in total coverage for out-of-pocket medical expenses caused by an accident.
