In the state of Texas, criminal background checks generated by an employer can go back seven years into an applicant's criminal and personal history. There are, however, some exceptions to this rule.

Felonies and misdemeanors both are part of a criminal record and stay on the record until the record is expunged. They stay on a criminal record indefinitely unless expunged, and they can be found through a background check subject to the statutory limitations on how far back a checker can look.

A misdemeanor conviction will remain on your criminal record permanently unless you receive a dismissal (sometimes erroneously called an “expungement”), or a governor's pardon. There is no time limit that passes and makes your misdemeanor fall off your record.

Convictions. Convictions received when 18 or over will be removed from standard and enhanced checks if: 11 years have passed since the date of conviction.

If you're convicted of a felony in Florida, it will remain on your criminal record for the rest of your life (unless you receive a pardon from the President or Governor).

Records of arrests that don't bring convictions also would be sealed. The law goes into effect July 1, 2023. The bill would apply to offenses like domestic violence. It excludes those convicted of serious and violent felonies, and felonies requiring sex offender registration.

You may request that a court seal your arrest records or criminal records. If a judge agrees with your request, the records will no longer be available to the public. However, some government agencies will still be able to see your sealed record. If the order is granted, the judge will use the CR-410 order form.

Class A and B misdemeanors: 1 year. Felonies: 3 years.
