Within 42 days after the effective date of the original Order of admission, any heir or legatee may file a petition with the court to require proof of the Will by testimony of the witnesses to the Will in open court or other evidence, as provided in Section 6-21 of the Probate Act of 1975 (755 ILCS 5/6-21).

In Illinois, the executor is entrusted with several duties which can be broadly classified as administrative, legal, and financial. The role often involves coordinating with the probate court and fulfilling tasks such as filing the will, inventorying the estate, and settling outstanding liabilities.

You can file the Final Report, send appropriate notices to all interested parties who have not consented and to all creditors whose claims have not been paid in full and start the running of a 42-day period. Within 14 days after the Letters of Office are issued, a Notice to Heirs and Legatees must be sent to all known heirs. This Notice must include the Petition for Probate, the Order admitting the matter to Probate, and a description of the rights of the heirs.

In general, beneficiaries are notified within three months of the date that the Will is filed with the probate court. Beneficiaries of a Trust document are notified much sooner.

Under section 28-4 of the Probate Act of 1975 (Illinois Compiled Statues 1991 755 ILCS 5/28-4) any interested person may petition the court to terminate Independent Administration at any time by mailing or delivering a petition to terminate to the clerk of the court.
