You're first option is to fight the ticket. In Indiana this is the only way to have your ticket fully dismissed. To do so you will have to officially plead not guilty and contest the ticket.

The Infraction Deferral period shall be for eight (8) months from the date an Infraction Deferral Agreement is filed with the Court. No Agreements shall be filed unless accompanied by the full Deferral Program fee of $209.50.

The Prosecuting Attorney established an Infraction Deferral Program in order to allow persons who have committed certain traffic violations to maintain a point free driving record.

Deferral Program Process If you wish to enter the Deferral program, you will sign an Infraction Deferral Agreement and pay a fee of $192.50. You do this instead of paying the ticket (i.e. do not pay the ticket and then request the Deferral agreement).

You can do this in one of three ways: Select the “not guilty” option on the ticket and mail the ticket to the listed address. Go to the court and inform the clerk of your decision to plead not guilty. Show up on the court date listed on your ticket and let the judge know; you will then receive a hearing date.

We withhold prosecution on the ticket; it is pending for 6, 9, or 12 months. At the end of a successful program, your offense will be dismissed. Your ticket will NOT be sent to the Bureau of Motor Vehicles, and your insurance should not be affected. You pay the deferral fee instead of paying for the ticket.

Point values for offenses range from zero to ten, depending on the violation. Points stay active on an individual's driving record for two years from the conviction date.

If you wish to enter the Deferral program, you will sign an Infraction Deferral Agreement and pay a fee of $192.50. You do this instead of paying the ticket (i.e. do not pay the ticket and then request the Deferral agreement).

Agree to commit no new traffic violations in Marion County for six months. Payment of the one-time fee of $229.00.

Instead of paying the $171 traffic violation ticket, the Infraction Deferral Program is offered by the Prosecuting Attorney to allow safe drivers to maintain their good driving record. After 6 months without another traffic violation your citation will be dismissed.
